REGULATIONS FOR RENTAL AND UNGUARDED AREA GENERAL CONTRACT CONDITIONS PURSUANT TO ART. 1341 OF THE CC

The service is offered to the public pursuant to art. 1336 of the civil code under the following conditions:

ART. 1. Parking is permitted in the parking areas according to the rules set out in the following general contract conditions pursuant to articles 1336 and 1341 of the civil code. Upon introduction of the vehicle and collection of the entry ticket, which bears the day and time of entry, a rental contract for an unattended area is concluded with the User without the obligation, on the part of the Bardolino Parking Company, of surveillance and custody, therefore the latter is not responsible for damage and theft committed or attempted to the cars or their accessories or to luggage, valuables and other objects left inside them.

The area surrounding the service building is equipped with video surveillance to protect only the building, the automatic cash register, vending machines and everything contained within it.

ART. 2. Entry to the car park takes place from the access gate that leads to the parking areas delimited by barriers, according to the following method: By withdrawing the entry ticket from the column positioned there, at this moment the Skidata system detects the "Camper" rate for vehicles (with bike racks, roof racks, luggage racks or similar) with a height greater than 2.15 meters, while for the Car rate less than 2.15 meters. Any consequences deriving from the loss of it are the responsibility of the User, as regulated by art. 8. Entry entails the authorization to park according to the rates displayed at the access gate and at the cash desk . The user is advised not to leave the ticket inside the vehicle exposed to sources of light and/or heat.

Pets are permitted. Owners must always pick up after their pets and ensure they do not soil the common parking areas.

The awning may only be opened within the limits of the parking space's designated signage. A small table and up to two chairs may also be placed, provided they do not occupy common spaces or adjacent parking spaces. Gatherings or group activities are not permitted.

ART. 5. For safety reasons related to compliance with the Highway Code, the Bardolino Parking Company reserves the right to reallocate vehicles, through an authorized company, within the parking lots, in a delimited area that is not accessible to other users. The costs related to the reallocation operations will be entirely borne by the User. The owner of the vehicle is required to pay the costs of the intervention even if the reallocation has not taken place and has not started due to the arrival of the offender. In the event of the need to carry out contingent and unforeseeable interventions, the Bardolino Parking Company reserves the right to reallocate vehicles in equivalent areas, without charging costs or penalties.

ART. 6. Payment must be made at the automatic pay station before collecting the vehicle. In order to apply the free parking allowances provided for in the tariff tables, it is mandatory to exit the car park within the pre-established time limits and it is necessary to validate the ticket at the automatic pay station. Staying in the car park beyond the time limits indicated in the free parking allowances will in any case result in the application of the parking rates in force. In the event of technical problems at the automatic pay stations or upon instructions from the staff, payment must be made at the manned pay station.

Payment for parking at the automatic machines can be made in cash, credit card or debit card.

ART. 7. The vehicle must exit within 15 minutes of payment. After the above-mentioned grace periods, the User will be required to present the payment ticket again and make a new payment according to the rate applied from the expiry of the previous one.

ART. 8. Failure to pay authorizes the Bardolino Parking Srl to not allow the vehicle to exit as provided for by article 2756 of the Civil Code.

The User who shows up at the cash desk without the entrance ticket is required to provide the documentation requested by the operator. In the event of loss of the entrance ticket, the User will be required to pay the sum corresponding to € 60.

ART. 9 Without prejudice to the provisions of art. 8, in the event of violation of these Regulations resulting in total or partial non-payment of the parking fee, a penalty pursuant to art. 1382 of the civil code (“effects of the penalty clause” and/or art. 17 paragraph 132 L. 127/97) equal to €50.00 will be applied, including reimbursement of expenses incurred for the verification of the evasion of the fee, without prejudice to any higher amounts that may be due.

ART. 10. When parking the car or Camper, the User acknowledges having read and accepted, also pursuant to art. 1341 of the Civil Code, all the rules contained in this regulation, undertaking to respect them scrupulously. Due to the nature of the service covered by the contract and the circumstances existing at the time of the conclusion of the contract, the sum of money constituted by the penalty provided for the failure or partial payment of the parking according to the discipline dictated by art. 9 of these general contract conditions does not constitute an unfair clause and does not require any signature.
